All rights not expressly granted to you under these Terms are reserved by Dynamic Motion and its licensors.
4.3 Limited License to Use the Website.
Subject to your compliance with these Terms, Dynamic Motion grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Website for your personal or internal business information purposes only. You may view the Website and, where technically enabled, temporarily store or print a reasonable number of pages solely for such purposes, provided that you:

5. Portfolio, Client Projects, Names, Logos and Trademarks
5.1 Use of Client Materials.
The Website may display names, logos, trademarks, service marks, trade names, designs, images, videos and other materials related to Dynamic Motion’s clients and their projects (Client Materials). Client Materials are used solely:
- To illustrate the nature and quality of Dynamic Motion’s services;
- To showcase past or ongoing work; and
- In accordance with rights and permissions obtained by Dynamic Motion from the relevant clients or as otherwise permitted under applicable law.
5.2 No Implied Endorsement.
The appearance of any client, name, logo, project, product, service or brand on the Website does not constitute or imply:
- Any endorsement, sponsorship or recommendation of Dynamic Motion by that client; or
- Any endorsement, sponsorship or recommendation of that client or its products or services by Dynamic Motion.
Any statements about client relationships are for descriptive purposes only.
5.3 Restrictions on Use of Client Materials and Portfolio Content.
You acknowledge and agree that:
- Client Materials and all portfolio or case-study content (including images, videos, project descriptions and related assets) are protected by the intellectual property rights of Dynamic Motion, its clients or third parties.
- You may not copy, download (except as may be technically necessary for normal browsing), reproduce, distribute, publish, publicly display, publicly perform, modify, adapt, translate, create derivative works from, or otherwise use any Client Materials or portfolio content without prior written permission from Dynamic Motion and, where applicable, the relevant client.
- You may not use any Client Materials or other third-party trademarks, logos or branding in any manner that is likely to cause confusion or that suggests sponsorship, endorsement or affiliation with any party without the prior written consent of the respective rights holder.
5.4 Third-Party Trademarks.
All third-party names, logos, trademarks, service marks and other brand identifiers appearing on the Website are the property of their respective owners. Nothing in these Terms or on the Website grants you any right or license to use any such third-party marks.
6. User Conduct and Acceptable Use
6.1 You agree that you will use the Website only for lawful purposes and in accordance with these Terms. You must not:
- Use the Website in any way that violates any applicable law, rule or regulation;

7. Submissions, Feedback and User-Generated Content
7.1 User-Generated Content.
The Website may allow you to submit, upload or transmit content, such as comments on blogs, messages via contact forms, testimonials, suggestions, questions, files or other materials (User-Generated Content).
7.2 Your Responsibility.
You are solely responsible for your User-Generated Content and for ensuring that it complies with these Terms and all applicable laws. By submitting User-Generated Content, you represent and warrant that:

7.3 License to Dynamic Motion.
By submitting User-Generated Content to the Website (including via contact forms, email or other communication channels with Dynamic Motion in connection with the Website), you grant Dynamic Motion a worldwide, non-exclusive, royalty-free, fully paid, transferable and sublicensable license to:
- Use, reproduce, distribute, display, perform, adapt, modify, translate, create derivative works from and otherwise exploit your User-Generated Content, in any media, for the purposes of operating, improving, marketing and providing the Website and Dynamic Motion’s services, and for other legitimate business purposes.
7.4 Feedback.
If you provide Dynamic Motion with any suggestions, ideas, proposals, testimonials or other feedback about the Website or Dynamic Motion’s services (Feedback), you acknowledge and agree that:
- Dynamic Motion may freely use, disclose, reproduce, license, distribute and otherwise exploit the Feedback in any manner and for any purpose, without obligation or compensation to you; and

7.5 No Obligation to Use or Retain Content.

arising out of or in connection with your access to or use of, or inability to access or use, the Website or any content, even if any Dynamic Motion Party has been advised of the possibility of such damages.
12.2 To the maximum extent permitted under applicable law, the total aggregate liability of the Dynamic Motion Parties to you for all claims arising out of or related to these Terms or the Website, whether in contract, tort or otherwise, will not exceed the greater of:
- The amount (if any) you have paid directly to Dynamic Motion for access to the specific portion of the Website giving rise to the claim during the six (6) months preceding the event giving rise to the claim; or
- A reasonable monetary amount determined by reference to the laws of the jurisdiction where Dynamic Motion is established, if no such payments have been made.
12.3 Nothing in these Terms is intended to exclude or limit any liability that cannot be excluded or limited under the laws of the jurisdiction where Dynamic Motion is established.
13. Indemnification
13.1 You agree to indemnify, defend and hold harmless the Dynamic Motion Parties from and against any and all claims, demands, actions, proceedings, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising out of or in connection with:

- Your violation of these Terms or any applicable law;
- Your User-Generated Content or Feedback, including any allegation that such content infringes or violates the rights of any third party; or
- Your misuse of any Dynamic Motion Materials, Client Materials or third-party content.
13.2 Dynamic Motion reserves the right, at its own expense, to assume the exclusive defense and control of any matter that is otherwise subject to indemnification by you, in which case you agree to cooperate with Dynamic Motion’s defense of such claim.
14. Governing Law and Dispute Resolution
14.1 These Terms and any dispute, claim or controversy arising out of or relating to these Terms or your use of the Website (a Dispute) will be governed by and construed in accordance with the laws of the jurisdiction where Dynamic Motion is established, without regard to conflict of law principles.
14.2 You and Dynamic Motion will endeavor to resolve any Dispute amicably through good-faith negotiations. If a Dispute cannot be resolved informally within a reasonable time, then, subject to applicable law:
- The Dispute may be submitted to the competent courts or dispute resolution body in the jurisdiction where Dynamic Motion is established; or
- If Dynamic Motion and you mutually agree in writing, the Dispute may be referred to mediation or arbitration or another alternative dispute resolution mechanism.
14.3 Nothing in this Section limits the right of either party to seek interim, injunctive or other equitable relief where permitted under the laws of the jurisdiction where Dynamic Motion is established.

15.1 Dynamic Motion may modify, suspend or discontinue any part of the Website, or introduce new features, at any time and without prior notice. Dynamic Motion will not be liable to you or any third party for any modification, suspension or discontinuation of the Website or any part of it.

Dynamic Motion may assign or transfer its rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, corporate reorganization or sale of assets.
16.5 Language.
These Terms are drafted in neutral English intended for an international audience. In the event of any translation, the English version will prevail to the extent permitted under the laws of the jurisdiction where Dynamic Motion is established.
